Terms and Conditions


Mountain Crawl Space Encapsulation LLC


By accepting this estimate, approving the proposal, or allowing work to begin, the client agrees to the following Terms and Conditions.


Acceptance of Agreement


Acceptance of this estimate constitutes a binding agreement between the client and Mountain Crawl Space for the work described in the scope of work. Any modifications to the scope must be approved in writing through a change order.


Deposit


A deposit is required to secure scheduling and materials. The deposit must be paid within three (3) business days of accepting the estimate. Failure to remit the deposit within this timeframe may result in removal from the project schedule.


Progress Payment


A progress payment of twenty five percent (25%) of the total project cost will be due when the project reaches approximately fifty percent (50%) completion. Mountain Crawl Space reserves the right to pause work until the progress payment has been received.


Final Payment


The remaining twenty five percent (25%) balance is due within three (3) business days of project completion.


Project completion is defined as substantial completion of the scope of work outlined in the agreement.


Failure to remit payment may result in collection actions, additional fees, and the filing of a mechanic’s lien as permitted under North Carolina law.


Change Orders


Any additional work or modifications to the original scope must be approved through a written change order.


All approved change orders are due in full upon agreement of the revised scope of work unless otherwise specified in writing.


Site Access


The client agrees to provide safe and reasonable access to the property, crawlspace, utilities, and work areas necessary to perform the project. Delays caused by lack of access, obstructions, animals, or other site issues may result in scheduling changes or additional charges.


Unforeseen Conditions


All work is based on visible and accessible conditions at the time of inspection. Hidden damage or unforeseen conditions may be discovered during the course of the project, including but not limited to:


Structural damage

Wood rot

Pest damage

Microbial growth

Water intrusion

Improper prior construction


If additional conditions are discovered, Mountain Crawl Space will notify the client and provide a change order for any additional work required.


Weather and Environmental Conditions


Crawlspace and foundation work may be affected by weather conditions including rain, flooding, freezing temperatures, or unsafe conditions. Mountain Crawl Space reserves the right to adjust project schedules when necessary to ensure safety and quality of work.


Materials and Substitutions


If specified materials become unavailable, delayed, or discontinued, Mountain Crawl Space reserves the right to substitute comparable materials of equal or greater quality.


Safety and Jobsite Conditions


Mountain Crawl Space reserves the right to suspend work if jobsite conditions become unsafe, hazardous, or unsuitable for workers or equipment.


Right to Refuse Service


Mountain Crawl Space reserves the right to refuse service to any individual or property at its sole discretion.


Right to Terminate Agreement


Mountain Crawl Space reserves the right to suspend or terminate the agreement if any of the following occur:


Nonpayment or late payment

Unsafe jobsite conditions

Harassment or hostile behavior toward staff or subcontractors

Conditions that prevent the safe or proper completion of the project


If the agreement is terminated under these circumstances, the client will be responsible for payment for all labor, materials, and services performed up to the date of termination.


Mechanic’s Lien Rights


Failure to make payments as agreed may result in Mountain Crawl Space exercising its right to file a mechanic’s lien against the property for unpaid labor, services, or materials in accordance with North Carolina law.


Payment Methods


Accepted payment methods may include check, ACH, credit card, or other approved payment methods listed on the estimate or invoice.


Agreement


By approving this estimate or allowing work to begin, the client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
